When an employee transitions from one employer to another, the law requires certain protections. In some countries, employees have “acquired rights” that effectively prevent the outsourcer from reducing the title, benefits and emoluments that the employee enjoyed in the original enterprise.
In addition, transitioned employees may have certain know how that is valuable to the enterprise and the outsourcer. The management of such knowledge should be kept in mind in any assessment, planning and implementation of an outsourcing.
